Terms of Service

Effective: June 2026

These Terms of Service ("Terms") govern your access to and use of Ember, a marketing product provided by Veste Health, a brand of ProActive Solutions for Life, LLC ("Ember", "Veste Health", "we", "us"), available at marketing-engine-xdr.pages.dev. By creating an account or using Ember, you agree to these Terms. If you do not agree, do not use Ember.

What Ember Is

Ember helps you create marketing materials — positioning, copy, landing pages, emails, social posts, calendars, and media — and, where you connect accounts and approve it, publish that marketing to social platforms. Ember applies general marketing frameworks to your inputs; it does not reproduce the text of any book. Generated content is a starting point — you are responsible for reviewing it before use, and Ember does not guarantee any marketing result.

Eligibility

You must be at least 18 years old, or the age of majority where you live, to use Ember. By using Ember you confirm that you meet this requirement and that the information you provide is accurate.

Your Account, Content, and Data

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account; notify us promptly of any unauthorized use. You retain ownership of the business information and content you provide, and you grant Veste Health a limited license to store, process, and — on your instruction — publish that content solely to operate and provide Ember to you. Our handling of your data is described in our Privacy Policy, which is incorporated into these Terms. We do not sell your data or use your content to train public AI models. You may export your data or permanently delete your account and associated data at any time — see Data Deletion.

Connected Accounts and Publishing

When you connect a social account, you authorize Ember to act on your behalf solely to publish content you create and approve. Publishing occurs only after you review and approve a specific post; Ember does not post automatically without your approval. You may disconnect at any time. You must comply with the terms and policies of any platform you connect, including Meta's Platform Terms.

Acceptable Use

• Use Ember only for marketing you are authorized to send and publish.
• No spam, scraping of individuals, or unsolicited messaging. Email must be permission-based and comply with CAN-SPAM and GDPR.
• No unlawful, deceptive, infringing, or harmful content.
• Do not attempt to reverse-engineer, scrape, or disrupt the service, or share your account in violation of these Terms.
• Any advertising spend is funded by you, through your own ad and payment accounts, and always requires your explicit approval. Ember is never the merchant of record for your sales.

Subscriptions and Billing

• Ember may be offered with free and paid tiers. Continued access to paid features requires a subscription.
• Subscriptions are billed in advance on a recurring basis through our payment processor, Stripe. We do not see or store your full card details.
• Your subscription renews automatically until you cancel. You can cancel anytime; cancellation stops future renewals and takes effect at the end of the current billing period.
• Except where required by law, payments are non-refundable for partial periods.
• We may change pricing or plan features; we will give notice of material changes, and changes apply to billing periods that begin after the change takes effect.

Intellectual Property

Ember, the Veste Health name and marks, and the software, design, and content of the service are owned by Veste Health and its licensors and are protected by applicable law. These Terms do not grant you any right to our trademarks or branding.

Third-Party Services

Ember relies on third-party providers (including Anthropic for AI processing, Supabase for data, Cloudflare for hosting, Resend for email, Stripe for payments, and the social platforms you connect, as described in our Privacy Policy). Your use of Ember may also be subject to those providers' terms. We are not responsible for third-party services we do not control.

Service Availability

Ember is provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the service will be uninterrupted or error-free, and usage may be subject to limits. We may suspend accounts that violate these Terms.

Limitation of Liability

To the fullest extent permitted by law, Veste Health and ProActive Solutions for Life, LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your reliance on Ember. Our total liability for any claim relating to the service will not exceed the amount you paid us in the twelve months before the claim.

Termination

You may stop using Ember and delete your account at any time. We may suspend or terminate access if you violate these Terms or to protect the service or other users. Provisions that by their nature should survive termination will survive.

Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the effective date above and, where appropriate, provide additional notice. Your continued use of Ember after changes take effect means you accept the updated Terms.

Governing Law

These Terms are governed by the laws of the United States and the state in which ProActive Solutions for Life, LLC is organized, without regard to conflict-of-law rules.
